House Approves FCC Obscenity Fine Hike

I don’t understand how the FCC’s “obscenity” rules are not a direct violation of the first amendment. Have they ever been challenged as unconstitutional?

I’m guessing they get away with it because they aren’t laws, they’re guidelines, and they only apply to people who want to use the public airwaves. How convenient. Maybe they shouldn’t call them public after all.
